Below you can find the applications and supporting information for Publicly Notified Resource Consent Applications.
Any person interested in the publicly notified application can make a submission on the application. In the instance of limited notification, a notice with a copy of the application is served only on those persons identified as being adversely affected.
Making a submission
A submission is simply a written statement from you about a notified Resource Consent application. The submission must be in writing and can either be in support or opposition of the application, or be neutral. Ensure you understand what the application is about, and what the effects are likely to be, by reading all of the information provided.
You can also talk to the applicant and discuss your issues and concerns with them. You may be able to reach an agreement without going through the formal submission process.
Your submission should:
- Be clear and to the point
- Support your views with good information
- Relate to issues that arise from the proposal
In your submission please clearly indicate:
- Whether you support or oppose the application, or if you wish to make a neutral submission
- Which parts of the application you are specifically concerned about
- Why you are making the submission
- What decision you want us to make or what outcome you want
- If we grant the consent, what are some of the conditions you want in place?
- If you want to attend a hearing and present your submission in-person
Submit your Submission

- Download the Submission Form 21 (use for submission on a Notice of Requirement)
- Email it to rmanotified@kaipara.govt.nz (you can also post or deliver it to one of our customer service centres (Dargaville or Mangawhai).
We must receive your submission on or before the submission closing date stated on the public notice or letter.
Remember you also need to send a copy of your submission to the applicant at the address given on their public notice or letter.

Commissioner Recommendation Decision from Minister of Education
Explanation and Update of Notice of Requirement processFollowing KDC receiving submissions on the above Notice of Requirement by the Ministry of Education (NoR), this is an update on the statutory process being followed under the Resource Management Act 1991 (RMA). The hearing was held on the 21 November 2023 and closed on 06 December 2023. Commissioner Smith has made a recommendation on the NoR to the Minister of Education under section 171 of the RMA. The recommendation was forwarded to the Minister on 19 December 2023 . A copy of the recommendation and reasons for the recommendation is available here. The Minister of Education must make a decision under section 172 of the RMA within 30 working days of receiving the recommendation as to whether or not the Minister accepts or rejects the recommendation, including the conditions. Thirty working days does not include 20 December 2023 to the 10 January 2024, or Waitangi Day. Therefore, the Minister’s decision is expected to be received by KDC by Thursday 22 February 2024. Once KDC has received the Minister’s decision, under section 173 of the RMA, KDC will notify all persons who made a submission and make it available on our website and at Council libraries and offices. Any person who made a submission on the NoR may appeal the Minister’s decision to the Environment Court within 15 working days of the date on which the notice of the decision was-issued. Please refer to Section 174 of the RMA , for the detail on appeals. |
